The short version
You are buying a license for one named person to use the software on as many Macs as they like, at home and at work. Family and organization licenses cover more named people. Licenses are tied to those people and cannot be resold, transferred or reassigned. The software is sold as it is today: I will do my best to keep it working and to keep improving it, but I cannot promise future versions or guarantee support. Keep backups. Your legal rights as a consumer are not affected by anything below.
The long version is what counts.
The agreement
1. Who you are dealing with
This agreement is between you and Frank Reiff, an independent software developer based in Luxembourg, who publishes software under the name publicspace.net. "I", "me" and "my" below refer to Frank Reiff and publicspace.net. You can reach me at support@publicspace.net.
2. What this agreement covers
This agreement applies to all software published by publicspace.net that you download from publicspace.net or receive from one of my resellers or bundle partners, including trial copies, together with its documentation and updates.
By installing or using the software you accept this agreement. If you do not accept it, do not install the software; if you have already paid, ask me for a refund (see section 11).
3. What you are allowed to do
The software is licensed, not sold. When you buy a license you receive a non-exclusive, perpetual license to install and use the software, in the major version you bought, for the license tier you chose:
- Single User: one named person. That person may install and use the software on any number of Macs that they personally use, for any purpose, including work. The license may not be shared with anybody else.
- Family: up to 5 named people belonging to the same family or household, each on any number of Macs that they personally use.
- Small Business: up to 20 named people belonging to the same organization.
- Business: up to 50 named people belonging to the same organization.
- Enterprise: any number of people belonging to the same organization.
Licenses are granted to named individuals. They are not seats: a license may not be reassigned to another person, and an organization may not substitute one person for another, in any manner, including when somebody leaves the organization. The Enterprise tier covers whoever belongs to the organization at any given time.
Bundles sold by publicspace.net, such as the Zen File Management Bundle, give you the rights of the tier you chose for each product included in the bundle at the time of purchase.
Licenses obtained through third parties, for example as part of a bundle, promotion or special offer, are always strictly Single User licenses, whatever the third party may have called them.
You may make copies for backup purposes.
4. Unlock codes
Your unlock code is personal to you or your organization. Keep it private. Do not publish it, share it outside the people covered by your license, or include it in any software or service. If an unlock code is published or widely shared, I may invalidate it and issue a replacement to the legitimate owner.
5. What you are not allowed to do
- You may not sell, rent, lend, sublicense, give away or otherwise transfer your license or unlock code to anybody else, whether as an individual or as an organization.
- You may not distribute the software or make it available to others, except for sharing an unmodified trial copy or a link to publicspace.net.
- You may not remove or alter copyright notices, or present the software as your own.
- You may not circumvent, disable or tamper with the unlock mechanism.
- You may not reverse engineer, decompile or disassemble the software, except to the extent that the law expressly allows this despite this clause (for example for interoperability under EU law).
Trial copies are for evaluation only. The limits of the trial are set out in each product. All the restrictions in this agreement apply to trial copies.
6. Updates, future versions and support
Minor updates to the major version you bought are free. Upgrades to a new major version are a separate purchase, unless you own a Forever license, which includes every future major version of the covered products if and when they are released.
I develop and sell this software as a one-man company. I have no obligation to release updates, new versions or compatibility fixes for future versions of macOS or future hardware, and nothing in this agreement, in a Forever license or on my website is a promise that any future version will be developed. A product may be discontinued at any time. Your license to the version you bought continues regardless.
Support is provided by email as a courtesy. It is not part of what you buy, and this agreement does not grant you any right to support, response times or fixes.
7. Third-party components
The software includes open-source components that are licensed under their own terms. Those terms are reproduced in the application's acknowledgements, and this agreement does not restrict any rights they give you.
8. Privacy and network connections
The software checks for updates and may fetch product news from publicspace.net. What is and is not collected is described in the privacy policy at https://www.publicspace.net/privacy.html, which forms part of this agreement.
9. Your files and your backups
Most of my products change your files: they rename them, move them, change their dates and metadata, or delete them. These changes are applied to your real files and most of them cannot be undone by the software. Preview carefully, test with non-critical data first, and keep a current backup of anything you cannot afford to lose. You are responsible for your data.
10. Warranty
I have written the software with care and I test it on the macOS versions it is sold for. The software is provided "as is" to the fullest extent the law allows. I do not promise that it will be free of errors, that it will suit your particular purpose or that it will work with every combination of hardware, operating system and other software.
If you are a consumer, the law of your country may give you rights that cannot be excluded by contract, including the right to have digital content that does not conform to the contract repaired, replaced or refunded. Nothing in this agreement takes those rights away.
11. Refunds
If the software does not do what you need, tell me within 60 days of purchase and I will refund the purchase price. Email support@publicspace.net with your order details. This is in addition to any statutory right of withdrawal you may have.
12. Limitation of liability
To the extent the law allows, my total liability to you for any claim arising out of this agreement or your use of the software is limited to the amount you paid for the license, and I am not liable for indirect or consequential losses, lost profits, lost data or the cost of recovering it.
Nothing in this agreement excludes or limits liability for death or personal injury caused by negligence, for fraud or willful misconduct, for gross negligence, or for anything else that the applicable law does not allow to be excluded or limited. Where you are a consumer, the mandatory consumer protection rules of your country of residence continue to apply.
13. Termination
This agreement lasts for as long as you use the software. It ends automatically if you materially break it, in particular sections 4 and 5. When it ends you must stop using the software and delete your copies. Sections 10 to 12 survive termination.
14. Changes to this agreement
I may publish updated versions of this agreement for new purchases and new major versions. The version in force when you bought your license continues to apply to that license. The current version is always at https://www.publicspace.net/support/EULA.html.
15. Governing law and disputes
This agreement is governed by the laws of the Grand Duchy of Luxembourg, and the courts of Luxembourg have jurisdiction, except that if you are a consumer resident in the European Union, the United Kingdom or another country whose law gives you the right to sue and be sued at home, you keep that right.
If any part of this agreement turns out to be unenforceable, the rest stays in force.
16. Product-specific terms
MacBreakZ. MacBreakZ suggests breaks, exercises and stretches. These are not medical advice and I am not a medical practitioner. Consult a doctor or physiotherapist before starting any new exercise, especially if you are pregnant, elderly or have a chronic or recurring condition. You follow the suggestions at your own risk.
